Terms and Conditions for Using Be Compleat Services

I. Glossary

For the purposes of these Terms and Conditions, the following terms shall have meanings specified below:

  1. Regulations – these Terms and Conditions, which define the terms and rules for using the Services provided by the Service Provider to Clients, primarily concerning professional nutrition advice, tailored to the individual conditions and goals of each Client.
  2. Service Provider – Agnieszka Kułaga, operating under the business name Be Compleat Agnieszka Kułaga, with business address at ul. Bielatowicza 11, 33-100 Tarnów, NIP: 8732999444, REGON: 120951277.
  3. Dietitian – specialist acting on behalf of the Service Provider, responsible for providing dietary advice to the Client in accordance with type of Services purchased by the Client.
  4. Client – individual of legal age with full legal capacity who uses the Services provided by the Service Provider. An individual who does not meet the criteria specified in the first sentence may use the Services only with written consent of the appropriate legal guardian.
  5. Services – set of services provided by the Service Provider to the Client, including diet consultations, gathering information regarding the Client’s health status and past eating habits, conducting anthropometric measurements, suggesting recommended tests and creating individualized diets. Scope of Services is specified on the website: https://becompleat.pl under the “Regulations” section.
  6. Online Service – nutrition consultation provided via online portal https://becompleat.pl, by phone, and/or using email and/or online messaging platforms, including conversation and/or analysis of test results submitted by the Client and/or creation of meal plans and/or supplementation, in accordance with the provisions set out in sections V-VII of the Regulations.
  7. Stationary Service – nutrition consultation provided in the office, including a conversation and/or analysis of the Client’s test results and/or creation of meal plans and/or supplementation, in accordance with the provisions specified in sections VIII-IX of the Regulations.
  8. Office – “Be Compleat” offices run by Agnieszka Kułaga with assistance of specialized team of dietitians. The offices are located in Tarnów at ul. Przybyłkiewicza 13 and in Kraków at ul. Hamernia 31c/2.
  9. Website – the website located at https://becompleat.pl/. The owner and administrator of the Website is the Service Provider.
  10. App – application for managing diets and facilitating communication with dietitian, provided by Utrition Sp. z o.o.
  11. Service Agreement – agreement entered into by the Service Provider and the Client, based on the terms outlined in these Regulations, with content consistent with these Terms and Conditions.
  12. Health Interview – questionnaire containing personal data of the Client regarding self-assessment of health, filled out and submitted by the Client.
  13. Food Diary – daily record of eating habits and dietary habits, kept by the Client for at least three full days, including detailed description and time of meals consumed.
  14. Dietary Program – dietary plan created for the Client, considering their health status and possible dietary preferences.
  15. Price List – list of current charges for using the Services. Prices listed in the Price List are gross prices.
  16. Business Days – weekdays from Monday to Friday between 10 AM and 5 PM, excluding public holidays in the Republic of Poland.
  17. Consultation – conversation with dietitian during which the Client’s test results, food diary and dietary questionnaire are analyzed. Health interview is conducted and discussion regarding the Client’s current dietary habits, daily organization, priorities and dietary therapy goals is held.

II. General Provisions

  1. To use services offered by the Service Provider electronically, the following technical conditions must be met:
    a) access to device capable of browsing websites and connected to the internet;
    b) properly installed web browser with enabled acceptance of cookies;
    c) possession of active email account and internet messaging system such as Google Meets.
  2. These Regulations apply to consultations and provision of services delivered directly in the Office, online and via the App, subject to specific provisions outlined in these Regulations. Consultations provided by Dietitians online are conducted via email and the Google Meets communicator and consultations provided in this mode in any other way are not foreseen. As part of the Consultation, the Client receives access to the App or written recommendations.
  3. Consultations are informational and do not replace medical advice.
  4. The Client acknowledges and agrees that services provided by the Dietitians through the Office (stationary) or online do not guarantee the expected outcomes set by the Client. The Service Provider, as well as any Dietitian, is not responsible for the consequences resulting from improper use of diet therapy plan (diet), recommendations or supplements provided to the Client by the Dietitian. The Client acknowledges and agrees that failure to follow or selective adherence to the Dietitian’s recommendations, as well as withholding information or providing false or incomplete and/or unreliable information, may negatively affect the Client’s health or life, especially the effectiveness of the diet or diet therapy plan, for which the Service Provider and the Dietitian are not liable.
  5. The Service Provider and any Dietitian have the right to refuse to provide a service if: the Client’s behavior indicates they are under influence of alcohol, drugs, other intoxicating or psychotropic substances or substances with a similar effect, the Client’s behavior is offensive toward the Service Provider, Dietitians or office staff, providing service could endanger the Client’s health or life, the Client refuses to cooperate with the Service Provider and/or the Dietitian.
  6. Prerequisite for using services provided by the Service Provider is reading and accepting these Regulations in full.
  7. The Client has the right to download the documents provided and print full pages or parts for personal use, provided that copyrights are not violated. No part of the website may be fully or partially copied for commercial purposes, published, transmitted electronically or otherwise modified or used without prior consent from the Service Provider.
  8. The Service Provider and Dietitians are obliged to keep all information obtained from the Client confidential in connection with providing services under these Regulations.

III. Additional Obligations of the Client and Declarations of the Service Provider

  1. The Client is required to provide the Service Provider with only true data and update this information so that it reflects the current factual state.
  2. In case the Client does not provide complete information regarding their health, the Service Provider is not liable for the consequences of the recommended actions.
  3. Before starting personalized diet (diet therapy plan), the Client must consult with a doctor about its applicability. Final decision on use of nutrition and supplementation for the Client lies with the doctor.
  4. Despite minimal risk of side effects, the Service Provider and/or Dietitian cannot predict all possible contraindications for recommended supplementation and nutrition methods and are not responsible for negative consequences of their use.
  5. D`ietary recommendations and supplements recommended by the Service Provider and/or Dietitian comply fully with the law. The Service Provider and/or Dietitian are not responsible for the Client taking supplements other than those recommended. Most importantly, the Service Provider and/or Dietitian are not liable for the discovery of any prohibited substances in the Client’s body.

IV. Technical Requirements for Cooperation with the Service Provider’s Information System for Online Services

  1. To use services of the Website, the following technical requirements must be met:
    1.1. active email account and messaging systems;
    1.2. access to device capable of browsing websites;
    1.3. active connection of the Client’s device to the internet;
    1.4. Mozilla Firefox/ Google Chrome/ Safari browser;
    1.5. acceptance of cookies, JavaScript scripts enabled, etc.
  2. Using operating systems and/or web browsers other than those specified above may cause difficulties in using services of the Website.
  3. The Client agrees not to provide any unlawful content.

V. Type and Scope of Online Services Provided

  1. The Service Provider offers paid services.
  2. Course of consultations preceding the provision of services is described on the Service Provider’s website at https://becompleat.pl under the “Services” section. The Client is required to review information provided in this section. This obligation is meant to prepare the Client for their visit as part of the provided service. Failure to familiarize oneself with procedures and unpreparedness for visit may result in the need to reschedule visit and charge the Client for related costs.
  3. To use online service, the Client selects type of consultation available on the website. The Client then makes payment in accordance with the procedure outlined in section VI of the Regulations.
  4. Confirmation of service is provided via email, confirming that payment has been recorded on the Service Provider’s bank account, along with information about consultation date.
  5. Within 14 days from consultation, the Client will receive diet therapy plan by e-mail to the address provided.
  6. Each consultation, regardless of its form, is paid service under these Regulations.
  7. If the Client is unable to attend consultation, they must cancel or reschedule at least 48 hours before scheduled visit.
  8. If the Client does not cancel or reschedule appointment, payment for consultation remains with the Service Provider.

VI. Payment for Online Services

  1. For services provided outside of packages, after selecting offer, the Client is required to pay for ordered service via bank transfer to the Service Provider’s account, indicating “Client’s First and Last Name” in transfer title or by using Easycart service.
  2. If the Service Provider does not confirm receipt of payment within 3 (three) business days from the date of order, order will be canceled.
  3. The price list for dietary services is available on the Website.
  4. All prices listed on the website are gross prices.
  5. The Service Provider reserves the right to change prices of services offered and to conduct and cancel promotional campaigns.
  6. Payment for services is equivalent to the conclusion of service agreement between the Client and the Service Provider under the terms outlined in these Regulations.
  7. Electronic payments, including card payments, are processed by payment operator. The payment operator is Easycart – Easytools Sp. z o.o., based in Warsaw, at al. Rzeczypospolitej 10/46, 02-972 (KRS pod nr: 0001002028, NIP: 9512554309, REGON: 523659062, kapitał zakładowy: 5 000,00 PLN).
  8. In event of refund request for transaction made by the Client with payment card, the Payment Operator will refund via the same payment method.
  9. For payment operators, processing time starts from positive authorization of the transaction.

VIa. Subscription and Package Services

  1. The services provided by the Service Provider are available in subscription model and as packages. All are detailed on the Service Provider’s website.
  2. For the subscription model, payment is collected in advance for period selected by the Client and is non-refundable. A new payment will be collected after the start of new subscription period.
  3. For the package model, the Client pays in advance. Package will be carried out according to description on the website. The Client declares at the time of ordering that they have read the regulations and wish to start the services before the 14-day period expires. Package must be used within 3 months. If not used, it will expire.
  4. Access to the App is equivalent to executing agreement regarding access to materials contained in the App.
  5. The payment operator is Easycart – Easytools Sp. z o.o., based in Warsaw, at al. Rzeczypospolitej 10/46, 02-972 (KRS pod nr: 0001002028, NIP: 9512554309, REGON: 523659062, kapitał zakładowy: 5 000,00 PLN). 

VII. Withdrawal from the Agreement for Online Services

  1. With the exception provided in section 4 below, the Client has the right to withdraw from the agreement within 14 days from its conclusion without providing any reason. In such case, the Client submits written statement of withdrawal to the Service Provider. Sending the statement before the deadline is sufficient to meet the term.
  2. The statement of withdrawal may be sent to the Service Provider by email at kontakt@becompleat.pl.
  3. The Service Provider will refund all payments made by the Client within 14 days of receiving the withdrawal statement. Refunds will be made using the same payment method as used by the Client, unless the Client agrees to another refund method that does not incur additional costs.
  4. The right to withdraw from the Agreement does not apply if the Service Provider has already fully performed the service and the Client was informed before the service was provided that once the service is performed, the right to withdraw would be lost and the Client explicitly agreed to this.

VIII. Type and Scope of Stationary Services

  1. The Service Provider offers paid services.
  2. Course of consultations preceding the provision of services is described on the Service Provider’s website. The Client is required to familiarize themselves with information provided in this section. Failure to do so may result in need to reschedule the visit and charge the Client for related costs.
  3. To use the stationary service, the Client should purchase appropriate package available on the Service Provider’s website and independently book visit date.
  4. The stationary service depends on the type of service/consultation selected by the Client. Detailed information is available on the website.
  5. If the Client is unable to attend the stationary consultation, they must inform the Service Provider at least 48 hours in advance.

Payment for Stationary Services

  1. Payments can be made via the EasyCart payment operator.
  2. The price list for dietary services is available on the website.
  3. All prices listed on the website are gross prices.
  4. The Service Provider reserves the right to change prices of services offered and to conduct and cancel promotional campaigns.
  5. Payment for services is equivalent to the conclusion of service agreement between the Client and the Service Provider under the terms outlined in these Regulations.

X. Data Protection

  1. The Service Provider is the administrator of personal data for Clients.
  2. The Client has the right to:
    1. access their personal data,
    2. be informed about processing of personal data,
    3. correct, complete, update or rectify personal data,
    4. withdraw consent at any time, request the deletion of data (right to be forgotten),
    5. restrict processing,
    6. transfer data,
    7. object to processing of personal data, including profiling,
    8. withdraw consent at any time without affecting legality of processing,
    9. file a complaint with the President of the Office for Personal Data Protection.

  2. At any time, the Client may contact the Administrator at email: kontakt@becompleat.pl.

XI. Extrajudicial Methods of Dispute Resolution and Claims

  1. The Service Provider does not agree to subject any disputes arising from agreements to mediation procedures. Details will be determined by the parties involved in the conflict.
  2. Consumers can review these methods at http://polubowne.uokik.gov.pl.
  3. Among other options, the Consumer may:
    1. apply to the permanent consumer arbitration court to resolve dispute arising from concluded agreement,
    2. apply to the provincial inspector of the Commercial Inspection to initiate mediation proceedings to resolve dispute between the Client and the Service Provider,
    3. use the help of the district (municipal) consumer rights advocate or social organization whose statutory task is to protect consumers.

  5. Consumers may also use the ODR platform at http://ec.europa.eu/consumers/odr.

XII. Complaints

  1. Complaints related to the Client’s use of the services of the Website may be submitted via email to: kontakt@becompleat.pl.
  2. Complaints should be submitted within 14 (fourteen) days from occurrence of the event justifying complaint.
  3. Complaint should contain the Client’s detailed identification and brief description of the event justifying complaint.
  4. Within 21 (twenty-one) days from receiving proper complaint, it will be considered; the Client will receive information at the email address provided in complaint.
  5. If the Client’s complaint is deemed justified, the Service Provider may offer the Client alternative form of service or another service of the same value as the one complained about.

XIII. Final Provisions

These Regulations come into force on 01.02.2025.

Polish law applies to the agreement between the Client and the Service Provider.

The Service Provider reserves right to change the Regulations. Provisions of new Regulations and/or any changes will be posted on the website. New Regulations come into force on date of publication. Changes do not affect Clients with whom agreements have already been concluded — for duration of the Service purchased.

In case of discrepancies or interpretational doubts, the Polish version prevails.
